DEED---This deed between Truman S.Day and Lucinda F. Day, his wife, of Hillsboro Fleming County , Kentucky, of the first part and John W. Emmons of the same place, county and state aforesaid of the second part "______path" that the said party of the first part in consideration of the sum of ( $1500.00 ) Fifteen hundred dollars ( $510.00 ) Five hundred and ten dollars in hand paid the receipt of which the party of the first part hereby acknowledges the remaining ( $900.00 ) due and payable as follows

( $650.00 ) Six hundred and fifty dollars and payable by note June 1st 1869. Third and last payment due by note by October 1st 1869 ( $340.00 ) Three hundred and forty dollars a lien is hereby retained on the hereinafter described _____ of _____and promises to secure the deferred payments, hath and doth by these presents, sell a lien and convey unto the party of the Second part, his heirs and assigns 5/8, Five eights of the entire undivided interest in and to the Dower interest or Estate of Mrs. Priscilla Day, widow of Alvin G. Day, deceased Rote of Fleming Co., Kentucky being the following undivided Eighths in said Dowery Estate or interest Viz:  Arthur F. Day and wife, G. F. Freeman and Elizabeth M. Freeman, John W.

Emmons and Martha E. Emmons, Charles Emmons and Margaret F. Emmons, Truman S. Day and wife____said____S. Day having heretofore rought and had conveyed to him by deed 4/8, Four eighths of said Dower interest being the first four eighths above mentioned which was conveyed by Deed to said Truman S. Day which Deed are of Record in the Clerk's office of the Fleming Co. in Deed Book No. 37 and on the following pages viz:  396, 397, 398, 450 said dower interest or Estate consists of the Day Tavern

_____ in Hillsboro, Fleming Co., Kentucky together withe the Stabling and lots and all appertonary? thereon as set forth in the cor______ allotment of said Widow's Dowery, Recorded in the Clerk's Office of Fleming Co., KY.

 

To have and hold said undivided interest of (5/8) Five eighths in _______ Dower Estate, hereby conveyed to Said John W. Emmons his heirs and assigns forever and the Said Truman S. Day and wife hereby agree to forever warrant, the Title to the aforementioned dower interests ( being 5/8 of the whole) from themselves their heirs and assigns and from all persons whatsoever it is understood by and between the parties that any Deed or Deeds to the within mentioned Dowery is in operation insuring the lifetime of the Said Mrs. Priscilla Day. In testimony whereof the Said Truman S. Day and Lucinda F. his wife hereunto set their signatures with full relinquishing of Dower. Given under our hands this 18th day of May 1869.

11.  MARTHA EMELINE4 DAY (ALVIN G.3, WILLIAM2, WILLIAM1) was born April 13, 1847 in Flemingsburg, Fleming Co. Kentucky, and died November 07, 1909 in Enterprise, Wallowa Co. Oregon.  She married JOHN W. EMMONS December 21, 1865 in Kentucky, USA, son of JOSEPH EMMONS and SUSAN BOWEN.

MISC: Wallowa Co. Courthouse Records states parents were Andrew Reavis Unknown   born in North Carolina and Susan Shom born in Kentucky???? John and Martha moved to Ill. in 1871 & 10 yrs later to Neb. In 1884 they came to Union Co. In 1893 to Wallowa Co. ...Nephews F.A. & L.P. Day of La Grande.

 

 

Notes for JOHN W. EMMONS:

MEMORIES: Per Bill Emmons, John was a teacher in Neb. and kept a six shooter on his desk. OBIT WCC Chieftian-Served thru the Civil War in the Southern army, passed away Monday night., Jan. 2, 1933 at the home of his grandson, Harold Emmons on Alder Slope. He had been in failing strength for months, owing to advanced age annd the end came as to one falling asleep from the weariness of many days filled w/ labor. Born 3/29/1843. At the close of the Civil War, he was married 12/21/1865 to Martha E. Day and they shortly moved to Ill. and later to Neb. In 1885, they came west and settled in the Grande Ronde Valley .Came to Wallow Co. in 1891. Mr. Emmons went to ranching near the Buttes using some of the land now in Clifford Wedes farm. His next move was to the Valley and he bought a farm on Alder Slope. Later he went into sheep ranching and bought a large ranch on Day Ridge later known as the Murdock Place. Selling this and getting out of the sheep business which was afflicted w/ one of its periodic depressions, he lived in the Valley a time, spent some months in Ca. and then went to a place in Brushy Canyon, before he retired from active work. His wife passed away 11/7/1909. There are seven surving children;Mrs. Delbert Davis, Neb, Alton R. , San Francisco, Wm. P. , add unknown, Leonard B. , Lostine, Charles D., Mrs. Delbert Homan (Jesse) , Enterprise. Mr. Emmons belonged to the older generation which built up the country from primitive conditions. He was a kind friendly man upwright and particular in conduct of business affairs and naturally everbody liked him. 2]1880 Census Bearcreek, Hancock Co., Ill. lists, John, Martha, Lillie, Alton, Wm., Lenard and Charles. James Holden was a farmhand. Pg. 26, also see 211

3] This certifies that I have carefully examined John Emmons and find him qualified to teach the following branches to wit: Orthography, Reading, Writing, Arithmatic, English, Grammer, Geographhy and having produced satisfactory testimonials as to moral fitness and capacity to teach, is hereby recommended to the citizins of Fleming County as a teacher under the Law regulating Common schools for the state of Kentucky.
